The learned counsel appearing for both the parties i.e. applicants and respondent nos.1 and 2 unanimously submit that the parties have settled the dispute amicably and as such, they do not want to proceed with the instant application. The present application is challenging the order below Exhibit 1 passed by the revisional court, thereby rejecting the avk 1/2

8-APL-1008-2019.doc application for condontion of delay for preferring the revision petition challenging the order dated 28th May 2018 passed in Criminal Miscellaneous Application No.402 of 2017 by the learned Judicial Magistrate First Class, Pune. It is reported that by the said order, order directing issuance of process against the applicants came to be challenged.

Both the learned counsel submit that the matter has been amicably settled and they would be filing Consent Terms before the learned trial Magistrate. The learned counsel appearing for respondent nos.1 and 2 fairly submits that in view of consent terms, he would be withdrawing the complaint filed against the present applicants. The learned counsel for the applicants tenders copy of Consent Terms. Those are taken on record.

Be that as it may, as the matter is being amicably settled, the present application stands disposed off. (A. M. BADAR, J.) avk 2/2
