On expressing my disinclination to entertain the Application of Applicant No.1 - Bhupendra Chhotalal Shah by looking to the nature of the accusation levelled against him and the material placed before me by the learned APP, the learned Counsel seek permission to withdraw the Petition.
As far as Applicant No.2 is concerned, the material placed on record is very much self-explanatory which include the copy of complaint and the bank statements etc., she is not attributed any specific role and i.e. a specific reason why she is not
Satish Sangar 2 9-ABA-2427-2022.odt arraigned as accused. The Applicant No.2 is apprehending an arrest and the learned APP states that she has been issued a notice under Section 41-A. Suffice to say, she shall report to the Police Station and respond to the said notice within a period of seven days from today. The Investigating Officer shall adhere to the procedure prescribed under Section 41-A and shall record the reasons in writing in case, he is desirous of arraigning her as accused or wanting to have her custodial interrogation.

The Application is disposed of as withdrawn as against Applicant No.1 and as far as Applicant No.2 is concerned, she stand protected by the above orders.
