At the outset the learned Counsel for the applicant seeks leave to withdraw the present application and prays that the Trial Court may be directed to expedite the trial. He on instructions submits that the trial so expedited should be conducted on day to day basis. The applicant alongwith other co-accused persons have been charged under Section 302, 201 read with Section 34 of the Indian Penal Code and other related Sections. The chargesheet in the present case has been submitted in the month of November 2014. The applicant is in jail since 24th August 2014.
2/2 ba.1721-2015 In the circumstances, the Trial Court is hereby directed to make an endevour to commence and complete the trial within a period of one year from today. Needless to mention that the trial so commenced shall be conducted on day to day basis as per requirement of the Section 309 of the Cr. P.C. If the trial is not completed within the period of one year from today, the applicant is at liberty to revive his request for regular bail on merits before the Trial Court.
