This application is taken out for the recall of order dated 11th June 2019 passed in Criminal Application No.175 of 2019. By the said order, the said application was dismissed for want of prosecution as nobody appeared in the Court on that day when the matter was called out.

By making averments in paragraphs nos. 2 to 7, the Applicant has given explanation why the matter went unattended on that day. The explanation in our view is satisfactory. Delay occurred in filing the present application is also explained. In these circumstances, we recall the order dated 11th June 2019 patilsr 1 / 2

passed in Criminal Application No. 175 of 2019 and restore the said application to file. Let the said application come up on board on 17th December 2019.
