Heard learned Counsel for the parties.

The parties have tendered the consent terms dated 22/01/2021. Learned Counsel for the parties submitted that the parties have reached an amicable settlement during the pendency of this Petition. Accordingly, they have fled the consent terms. The consent terms are duly signed by the Petitioner - husband as well as the Respondent - wife. The same are also signed by Advocate for the Petitioner as well as Advocate for the Respondent. The respective Counsel identifed the Petitioner as well as Respondent. Aadhar Cards of Hemata Sunil Verma and Sunil Kishorilal Varma are also produced on 1/3

record. Even original was verifed by the Court Ofcer. I have gone through the consent terms. Learned Counsel for wife has received Demand Draft of Rs. 6 lakhs in terms of the consent terms.

In terms of clause (B) of the consent terms, application would be made to the Family Court at Bandra, Mumbai for dissolution of marriage under section 13B of the Hindu Marriage Act by converting Petition A/2158 of 2019 fled by Respondent - wife within 30 days from the date of fling of the present consent terms. The Family Court to thereafter process the application and pass appropriate orders in view of these consent terms.

I have interacted with the Respondent - Hemalata who is identifed by her Advocate Shri Vyas. He says that the consent terms are voluntarily entered into and there is no force or coercion on her and she is satisfed with the settlement arrived at between the parties. The Petitioner as well as husband undertake to abide by the terms of the consent terms. The consent terms are taken on record and marked 'X' for identifcation.

The Writ Petition is disposed of in terms of the consent terms. In view of the facts and circumstances of the present case, 6 months cooling period may be waived of for passing the decree under section 13(B) of the Hindu Marriage Act.
