The learned Advocate appearing for the applicant / appellant has clarified that by the instant application, the applicant/appellant is also seeking his enlargement on bail during pendency of the appeal filed by him.

The applicant / accused is convicted of offences punishable under Sections 7, 13(1)(d) and 13(2) of the Prevention of Corruption Act, 1988 (For Short, "PC Act"). For offence punishable under Section 7 of the PC Act, he is sentenced to suffer rigorous imprisonment for three years and for offence punishable under Sections 13(1)(d) read with 13(2) of the said Act, the applicant/accused is sentenced to suffer rigorous imprisonment for four years. Substantive sentences are directed to run concurrently. 3.

Heard the learned Advocate appearing for the applicant as well as the learned Advocate appearing for the CBI. The learned Additional Public Prosecutor appears for the State. 4.

Short sentence of imprisonment is imposed on the applicant/accused. He was on bail during the pendency of the trial. The applicant/accused has deposited the entire amount of fine imposed on him. It is seen that he has not mis-used his liberty. Therefore, the order;

:: ORDER ::

(i) Substantive sentence of imprisonment imposed on the 2/3

applicant is suspended and he is directed to be released on bail on his executing P.R. Bond in the sum of Rs.15,000/- and on furnishing surety in the like amount by him.

(ii) At the request of the learned Advocate for the applicant/accused, initially the applicant/accused be released on furnishing cash security of Rs.15,000/- for a Digitally signed by Vina Arvind Khadpe Date:
