At the outset the applicant who is appearing in person submitted that he does not wish to press for the relief sought in paragraph 12(iv). Leave granted to delete the said prayer. 2.

By this application the applicant has sought to direct the learned Metropolitan Magistrate, 35th Court, CST, Mumbai to expedite the case No. CC 11/PS/2009. The report of the Metropolitan Magistrate was called for. A perusal of which clearly indicates that the Magistrate has made sincere attempts and efforts to dispose of the matter expeditiously. The reasons for not being able to dispose the matter expeditiously are spelt out in the said report. The reasons clearly indicate that the applicant as well as accused were responsible

jsn APPP No.756_2015 for delaying the matter. The report also reveals that the proceedings were stayed by the High Court as well as the Sessions Court. The stay was subsequently vacated and thereafter the matter is being taken up expeditiously. Under the circumstances, I do not find any reasons to give further directions to the learned Metropolitan Magistrate. 3.

The application is dismissed.
