DATE : 3RD JANUARY, 2023 P.C:- Mr. Deshpande, learned counsel for the petitioner on instruction states that his client would appear before the Deputy Collector, Rehabilitation on 16th January, 2023 at 11.00 a.m. and would furnish all documents called for so as to enable the Deputy Collector to take a decision to allot the plot to the petitioner, being the project affected person. Statement is accepted.

Ms. Solunke, learned A.G.P. for the respondent State, states that

KVM 2/2 4 - CP 813 OF 2022.doc if such documents are submitted on 16th January, 2023, an appropriate decision would be taken to allot the land to the petitioner as a project affected person within four weeks thereafter. Statement is accepted. 3.

Contempt petition is disposed off in the aforesaid terms. No order as to costs.

It is made clear that in view of the statement made by both the parties as aforesaid, we do not propose to take any action against the respondents under the provisions of the Contempt of Courts Act, 1971, at this stage. If the statement made by the respondents is not complied with by the respondents, this Court would initiate an action under the provisions of the Contempt of Courts Act, 1971, for not complying with the order dated 25th January, 2019 in Writ Petition No. 7807 of 2013 and the order passed by this Court today. 5.

Place the matter on board for reporting compliance on 23rd February, 2023 to be placed on Supplementary Board. [M. M. SATHAYE, J.] [R. D. DHANUKA, J.]
