Learned counsel for the Respondent-wife makes a grievance that though there is no stay to the impugned decree of maintenance dated 27th June 2013, from June-2015, the Appellant-husband has not paid alimony in terms of the impugned decree. 2.
Issue show cause notice to the Appellant calling upon him to show cause as to why Family Court Appeal No.166 of 2013 should not be dismissed in exercise of powers under Rule 11 of Order XXXIX of Code of Civil Procedure, 1908 on account of his failure to comply with the impugned judgment and decree. Learned advocate for the Appellant takes notice. The Appellant to file reply within a period of two weeks. Place the appeal under caption "directions" on 21st April 2016 when appropriate orders will be passed on the basis of show cause notice.
