1] Heard Mr. Joshi, learned counsel for the petitioner and Mr. Yagnik, learned APP for the State.
2] The petition is filed seeking direction to respondents to register F.I.R. against delinquent police officials from Kolhapur. The petitioner has alleged that the functionaries of the Police Department with the corrupt, illegal and malafde motive are permitting private entrepreneurs to advertise within the premises of the Police Stations and in some cases advertisements of mobile operators are found on the boards of various police stations within the District of Kolhapur. 1/2
14 wp 3063 of 2016.odt 3] Even assuming that the petitioner's allegation is correct, we do not find any criminal offence is made out. We are, therefore, not inclined to grant this relief.
4] The petitioner has also sought direction to initiate departmental actions against police officials from Kolhapur. However, we are unable to grant such type of relief in Criminal Writ Jurisdiction.
5] The petitioner is at liberty to approach higher authorities to point out the alleged irregularities.
