Applicant's S.C. Suit No. 2848/2013 was dismissed by the Learned Judge, City Civil Court, Dindoshi, Mumbai vider judgment and order dated 19th April, 2018. Feeling aggrieved and dissatisfied by the said judgment, Plaintiff has instituted the appeal along with an application, seeking 32 days delay occurred in presenting the appeal.

Heard learned counsel for the parties. The averments in paragraphs 8 and 9 of the application, disclose a 'sufficient cause', to condone the delay. Accordingly, delay is condoned. Application is allowed and made absolute in terms of prayer clause (a). 3.
