Consent Terms are tendered by the learned counsel appearing for the appellant and the learned counsel appearing for
rpa 2/3 the respondent. The Consent Terms are singed by both the appellant and the respondent and their respective advocates. The appellant and respondent are personally present in the Court and they accept the correctness of the contents of the Consent Terms. By consent, the order of refusal of registration of Family Court Appeal Stamp No.32131 of 2015 is hereby set aside and the said Appeal is restored.
We have perused the Consent Terms. While maintaining the decree of divorce, the other parts of the impugned decree have been modified by consent. Accordingly, we pass the following order:
:: O R D E R ::
(i) The three Family Court Appeals and Cross Objection are disposed of in terms of the Consent Terms taken on record and marked "X" for identification;
rpa 3/3 (ii) There shall be a decree drawn in terms of the Consent Terms in Family Court Appeals and Cross Objection;
(iii) Pending Civil Applications do not survive and the same are dispose of;
(iv) The original documents in relation to the minor child which are filed on record by the appellant-wife shall be returned by the Family Court to the Appellant - wife on a formal application being made on that behalf. The appellant - wife will place on record photocopies of the original documents.
