1) The present application under section 438 of the Code of Criminal Procedure, 1973 is filed directly before this Court. 2) The judicial propriety demands, that the applicant shall first approach the Court of Session and if he fails to get any relief from the Sessions Court, then he may approach this Court. 3) In view of the above, the present application is dismissed by granting liberty to the applicant to approach the Sessions Court.
