By a reasoned Order dated 22.08.2017, the Applicant has granted interim relief.

Perused the papers of investigation.

During the course of investigation, it is revealed that as a matter of fact the Applicant by mortgaging his residential premises has obtained a loan of Rs.85 lakhs from the Bank and the said amount has been transferred in the account of his wife Smt. Yogita Khinda for onward payment to the investors. The record further indicates that the Applicant has also extended financial help to his wife in settling the claims of investors arisen from the present crime. The record further indicates that Applicant has no role to play in the present crime and it is only Sneha Chavan 1/2

7 aba 1480-17=.doc because he is the husband of principal accused Smt. Yogita Khinda, he has been roped in the present crime as an accused by the investors. After taking into consideration the record of investigation, this Court is of the view that the custodial interrogation of the Applicant for further investigation of the present crime is not necessary.

In view thereof, the interim relief granted by an Order dated 22.08.2017 is hereby confirmed. However, the condition to attend the Investigating Officer is waived.
