The learned counsel for the applicant submit that during the pendency of this application, investigation is completed and charge-sheet is filed. Hence, the learned counsel for the applicant, upon instructions, seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice with further liberty to file a fresh application before the Sessions Court under Section 439 of Cr.P.C. The application stands dismissed as withdrawn with liberty as prayed. 2.

It is made clear that this application has not been heard on merits.
