Learned Counsel for the Applicant fairly pointed out that the earlier application preferred by the Applicant was dismissed as withdrawn by the coordinate Bench (Coram : Smt. Revati Mohite Dere, J) by an Order dated 25.04.2016.
As Smt. Revati Mohite Dere, J. is having an assignment as visiting Judge at Nagpur, by an Administrative Order dated 07.11.2017 passed by the Hon'ble the Chief Justice, the present application is placed before this Court for hearing. The record indicates that the Applicant was in jail since 15.05.2015 i.e. about 30 months till today and it is submitted that till date, the prosecution has not examined even a single witness in the present crime. In view of the above, the Additional Sessions Judge, seized of the trial Sneha Chavan 1/2
29 ba 1959-17=.doc arising out of C.R. No. 77 of 2015 registered with Indira Nagar Police Station, District Nashik is hereby directed to expedite the trial and to make an endevor to conclude the same within a period of one year from today. The Applicant is at liberty to file a fresh application for bail before the Trial Court if the trial arisen out of C.R. No. 77 of 2015 registered with Indira Nagar Police Station does not conclude within the aforesaid stipulated period. Application is disposed of in the aforesaid terms. (A.S.GADKARI, J.)
