By the present Petition, the Petitioner, an accused in C.R No.709 of 2015 registered with D.N.Nagar Police Station, Mumbai, under Sections 354(A), 354(D), 509, 506(II) of IPC, has prayed for quashment of C.C No.1326/PW/2018 arising out of C.R No.709 of 2015, by consent of Respondent no.2 victim.

Learned Advocate for Respondent no.2 submitted that, Respondent no.2 has affirmed an Affidavit dated 27th March 2023 and in it she has in unequivocal terms stated that, she is giving her MANISH SURESH THATTE MANISH SURESH THATTE Date: 2023.04.05 10:02:53 +0530 consent to quash said proceedings i.e. C.C No.1326/PW/2018 pending on the file of Metropolitan Magistrate, 10th Court, Andheri, Mumbai.

2 of 2 46.WP.3623.2022.doc Respondent no.2 is personally present in the Court and through her Advocate reiterated the facts mentioned in the Affidavit and gave her consent for quashment of said proceedings. 3.

In view thereof, the Petition is allowed in terms of prayer clause 7(a).
