CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 11681 OF 2017 BHARAT DASHARATH PANDIT Shri Satish Ramdas Salve .... Petitioner.

V/s The Chancellor, the Savitribai Phule Pune University and Anr.

..... Respondents.

----- Mr. Popat R. Rathod for the Petitioner.

Mr. Rajendra Anbhule for Respondent Nos. 1 and 2. ----- by BHARAT DASHARATH PANDIT Date: 2024.02.16 18:31:48 +0530 CORAM : A.S. CHANDURKAR & JITENDRA JAIN, JJ.

DATE : 16th FEBRUARY, 2024 P.C. :

1] Heard.

2] The Petitioner with an intention to prosecute five years law course appeared in 3rd year examination that was conducted in April 2002. He was required to obtain an aggregate of 400 marks out of 800 for being declared as pass. He however has secured 376 marks and thus has been treated as fail with ATKT. The Petitioner seeks permission to complete the said course by reappearing in the 3rd year examination for securing the aggregate marks. 3] Having heard the learned Counsel for the parties and having 1/2 BDP-SPS

perused the documents on record, we find that the Petitioner was a student of Symbiosis Law College, Pune in April 2022. This College is now no longer affiliated to University of Pune and hence presently it cannot be said that the Petitioner is a student of an affiliated College of the University. Secondly, as per Circular No.376 of 1993, degree course in law was required to be completed within a period of six years. Though this Circular pertains to 3 years degree course, it is clear that a period of more than 20 years now elapsed since the Petitioner appeared in the 3rd year examination. 4] In view of aforesaid, no relief can be granted to the Petitioner. The Writ Petition is therefore dismissed.
