The learned counsel appearing for Respondent No.5, on instructions, makes statement that the matter is pertaining to and revolving around the election of Respondent No.4 (Datta Sahakari Sakhar Karkhana Limited) where the liquidator was already appointed. The statement is made that the said society is already transferred to Dalmiya Bharat Sugar Karkhana Limited long back. Therefore, in view of this, the issue and the challenge so raised becomes infructuous.
This Court, by reasoned order dated 22.12.2006, has made some observations and I am maintaining the said observations so made in the said order. In view of subsequent development so recorded above of transfer, I see no reason to keep this matter pending. However, liberty is granted to the Petitioner to apply for appropriate order in case they get instructions otherwise for modification and/or even for revocation of the order so passed today. The writ petition is disposed of as infructuous. In view of disposal of writ petition no.7231/2006, Civil

In view of above, writ petition no.7493/2006 is also disposed of accordingly as the same also arises out of the common order in question.
