This is an application for modification of order dated 3-7-2018 passed by learned Additional Sessions Judge, Greater Bombay in Bail Application No.1045 of 2018. The applicant was granted bail by the Sessions Court vide aforesaid order on a condition that the applicant shall deposit Rs.5,19,597/- in two installments. The applicant was directed to deposit 50% of the aforesaid amount on or before fifteen days from the date of release and rest of the amount within fifteen days thereafter. It was further observed that in case applicant makes default in depositing the first installment, the bail application shall automatically stand cancelld without further reference to the Court. Learned advocate for applicant states that the said order was partly complied with by depositing Rs.2,59,799/- within fifteen days after the date of his release.
However, on account of financial constraints, the applicant could not deposit the balance amount and hence he preferred an application for extension of time to deposit the said amount. The said application was rejected on 2-8-2018. Hence, the Manish S Thatte Manish S Thatte Date: 2018.09.
2 of 2 931.APPLN.435.2018.doc applicant has approached this Court for relaxation of the said condition by extending time to deposit the same amount. 2.
Learned advocate for applicant, on instructions, submits that he would deposit Rs.1,00,000/- on or before 26-9-2018 and the balance amount of Rs.1,60,000/- lakh on or before 10-10-2018. The statement is accepted as an undertaking to this Court. In view of the statement, the application is disposed off with a direction that the applicant shall deposit Rs.1,00,000/- before the Trial Court on or before 26-9-2018 and balance Rs.1,60,000/- before the Trial Court on or before 10-10-2018. Criminal Application No.435 of 2018 stands disposed off in above terms. Parties to act on authenticated copy of this order issued by registry.
