A praecipe is moved by the appellant - insurer for withdrawal of the appeal.

It is submitted that the entire amount of compensation has already been deposited with M.A.C.T., Sangli. 3.

The learned Counsel for the respondents is ad idem as regards deposit of the entire amount of compensation. 4.

The appeal, therefore, is permitted to be withdrawn and as such stands disposed of as withdrawn.

The statutory deposit of Rs.25,000/- be transferred to M.A.C.T., Sangli, who, in turn, shall pass necessary orders as regards refund of the same on an application being moved in that behalf. 6.

The Court Fees shall also be refunded as per Rules. 7.

In view of the disposal of the Appeal, pending Civil Application also stands disposed of.
