The applicant is seeking pre-arrest bail in C.R.No.I-396/16 registered with Manpada Police Station, Thane, for the offences punishable under Sections 376D, 498A, 323, and 506 r/w 34 of IPC. 2.

The prosecution case against the present applicant is of abetting crime of rape by threatening the victim / complainant of acid attack if she discloses the incident of rape to any other person. URS 1 of 2

Apart from above, there are no allegations against the applicant.

The husband of the applicant is a co-accused claimed to have raped the complainant. The co-accused was already arrested and released on bail.

In the above-referred background, in my view, the custodial interrogation of the applicant is not required. Hence the following order :- (i) In the event of arrest of the applicant in C.R.No.I-396/16 registered with Manpada Police Station, Thane, for the offences punishable under Sections 376D, 498A, 323, 504 and 506 r/w 34 of IPC, the applicant shall be released on executing PR Bond in the sum of Rs.25,000/- with one or two sureties in the like amount.

(ii) The applicant shall attend the concerned police station from 27st to 29th December, 2016 between 10 a.m. to 12 noon and thereafter as and when called.

(iii) The applicant shall not tamper with the prosecution evidence and / or influence the prosecution witnesses. (N. W. SAMBRE, J.) URS 2 of 2
