Here, the petitioner is based at Nashik and is seeking admission to the Health Science Course after clearing the NEET/CET Examinations. The tribe claim had to be verified as a pre-condition, else, the petitioner's admission would not be confirmed.
The Committee had passed an order almost in identical terms and applying the same reasoning as was not accepted by this Court and today itself we decided Writ Petition No. 8843 of 2018 Neeraj Sanjay Thakur minor through father vs. State of Maharashtra & Ors. For the same reasons and identical conclusion, this writ petition also succeeds. Rule is made absolute in terms of prayer clauses (a) and (b). The certificate of validity be issued by the second respondent Committee tomorrow i.e. 10th August, 2018, by 12:00 noon.
The learned AGP is directed to communicate this order to the Committee forthwith. This order is subject to the scrutiny and verification of the certificate on which reliance is placed by the petitioner. A show cause notice has been issued to SRP 2/3
him. The adjudication in pursuance of that show cause notice will decide the fate of this petitioner.
