P.C:- This Civil Revision Application (CRA) along with the Civil Application therein, was moved for urgent reliefs yesterday i.e. 28th August, 2017. It is kept on board today.

Mr. Saroagi, learned Counsel appearing for the Applicant in support of the CRA seeks leave to withdraw this CRA with liberty to file first Appeal from the order dated 1st August, 2017 passed by the City Civil Court, Bombay. The impugned order has rejected the Petitioner's plaint under Order VII Rule 11 of the Code of Civil Procedure, 1908. The Civil Revision Application is disposed of as withdrawn with the aforesaid liberty.

Needless to state that Civil Application in the CRA also does not survive and same is also dismissed as infructuous. (M.S.SANKLECHA,J.) S.R.JOSHI
