The applicant is seeking pre-arrest bail in Crime No.473 of 2022 registered with Shirur Police Station, Pune (Rural) for the offences punishable under Sections 323, 324, 326, 504, 506 r/w. Section 34 IPC. 2.

The prosecution case is, the applicant by using sharp weapons assaulted two of the victims.

The contention of Mr. Joshi are, there are no criminal antecedents and absence of motive. According to him, on trivial issues, they started quarreling, which resulted into a fight.

Learned APP, based on investigation papers, would oppose the prayer.

The statement of the eye-witnesses and the injury certificate certifying the victim having suffered grievous injury sufficiently implicates the applicant in the offence punishable under Section 307 IPC. As the necessary ingredients can be inferred from the injury certificate and the statement of the eyewitnesses, no case for grant of bail is made out. Application stands rejected accordingly.
