By an order dated 11.09.2015 the applicant was granted interim relief. The learned APP submitted that the documents annexed to the present application pertaining to the treatment being taken by the applicant for 'cancer' has been verified by the Investigating Agency and the same are found to be genuine. She further submitted that the Investigating Officer is not present today to give further instructions.

The record discloses that the Investigating Officer was not present in this Court for giving instructions to the learned APP on 11.09.2015, 24.11.2015, 09.12.2015, 22.12.2015 and 01.02.2016. It 1/2
(6) ABA 1320-15 appears that the Investigating Officer is not interested in investigating the present crime qua the applicant. May it as it may, after taking into consideration the fact that the applicant is a patient of 'cancer' and is undergoing the radiation treatment under the supervision of experts, as can be discerned from the documents annexed to the present application, I am of the opinion that the present application can be allowed on the medical ground. In view of the same, the interim relief granted by the order dated 11.09.2015 is hereby confirmed.
