The learned counsel for the Applicant submits that for non removal of the office objection Writ Petition No. 4324 of 2016 stood dismissed. He submits that there was some bonafide mistake on the part of the counsel which was appearing earlier for the Petitioner and therefore said objection could not be removed within time. The prayer Vishal Parekar 1/2

prod-13-caw-2442-2016 has been made to condone the delay in filing the Civil Application and restore the Writ Petition to its original number. 4.

For the reasons stated in the Civil Application, the delay in filing the Application is condoned.

Keeping in view the aforesaid submission and the averments made in the Civil Application supported by the affidavit, we allow the Civil Application and direct restoration of Writ Petition No. 4324 of 2016 to its original number subject to removal of office objection within two weeks.
