1] The applicant has been granted interim relief by an order dated 2nd September, 2016.
2] It is the prosecution case that the investigation agency conducted raid on the establishment by name U-Turn UFO, the Lounge situated at Dimple Arcade Society, Asha Nagar, Kandivali (East), Mumbai. The said establishment has been granted licence by the Competent Authority to conduct a Hukka Parlour. At the time of raid it was noticed that the board of "Smoking Zone" was not displayed in the said establishment. The investigating agency also found one minor girl as a customer at the said place. The applicant is conductor of the said establishment

3] The First Information Report is lodged by the first informant a police head constable attached to Dahisar Police station, Mumbai. During the pendency of the present application the applicant was directed to attend the investigating officer on stipulated dates. The record of the investigation reveals that the applicant did attend the investigating officer and joined the process of investigation. I am of the view that the custodial interrogation of the applicant for investigating the present crime is not necessary. 4] In view of the above interim relief is granted by order dated 2nd September, 2016 is hereby confirmed. However, the applicant is directed to attend the investigating officer as and when called for between 10.00 am to 12.00 noon till the filing of the charge-sheet.
