This appeal is under Section 37 of the Arbitration and Conciliation Act, 1996 challenging an order passed by the District Judge - 4, Solapur in an application challenging an award under Section 34. Learned Counsel for the Appellant submits that the parties have arrived at settlement and that the Appellant / Judgment debtor has paid an amount of Rs.8,86,109/- towards the full and final settlement of the award and the settlement has been recorded by an order passed by the District Judge, Solapur, on 28 December 2015. Learned Counsel, accordingly, seeks leave to withdraw the appeal.

The appeal is dismissed as withdrawn. Refund of court fees in accordance with the applicable rules.
