This is an application for modification of order dated 23rd July 2018. The applicant was directed to be released on bail on furnishing PR bond in the sum of Rs.25,000/- with one or two solvent local sureties in the like amount. It is submitted by the advocate for applicant that applicant is resident of Uttar Pradesh and hence could not arrange local sureties. Learned APP submitted that the reasons for directing him to furnish local sureties is that the applicant is resident of Uttar Pradesh. It is further submitted that before his arrest, the applicant was absconding and had gone to Nepal after commission of crime and thereafter he could be arrested in this case. If the condition is relaxed, as prayed for by the applicant, there is every likelihood that the applicant would not be traceable.

It is noted that the applicant is involved in offence under Section 302 of Indian Penal Code. Considering the submissions advanced by learned APP, no case for relaxation is made out. The application is rejected. (PRAKASH D. NAIK, J.) MST Manish S Thatte Manish S Thatte Date: 2018.09.
