Heard learned counsel for the applicant and the learned APP for the respondent - State. 2.

Learned APP on the instructions of Mr. Arun Digole, the investigating officer, who is present in Court states that as of today, the investigating officer does not intend to arrest the applicant. She submits that the applicant is being called only for assisting the

investigation.

In view of the statement made by the learned APP on the instructions of the investigating officer, learned counsel for the applicant seeks leave to withdraw the application. If the investigating officer intends to arrest the applicant in the said case, the investigating officer of the Tilaknagar Police Station, Mumbai shall give 72 hours prior notice to the applicant.

With the aforesaid directions, the Application stands disposed of.
