M.C.A. No. 252 of 2023 is tagged with M.C.A. 486 of 2022, it has no relevance, hence it be de-tagged.

By this application, applicant is seeking transfer of D.V. proceeding pending before J.M.F.C., Nashik to Family Court at Nashik. Learned counsel for the applicant submits that respondent has filed three proceedings, the same are pending before the Family Court at Nashik. The said three proceedings are clubbed by the Family Court at Nashik. Hence, requested to transfer the D.V. proceeding pending before the J.M.F.C., Nashik to Family Court at Nashik.

Learned counsel for the respondent strongly objected to allow the application on the ground that no specific reason is given for transfer of 1/2

S.S.Kilaje 17-MCA-252-23.doc the proceedings and though the other proceedings are clubbed it cannot be a ground to transfer the D. V. proceeding pending before the J.M.F.C., Nashik to Family Court at Nashik. Hence, requested to reject the application.

I have heard both the learned counsel. All the three proceedings filed by the respondent are pending before the Family Court at Nashik and all the three proceedings are tagged together. The respondent has filed D.V. proceeding which is pending before the J.M.F.C., Nashik. If this proceeding is transferred to the Family Court at Nashik, it would be convenient for both the parties as well as Court to decide all the matters together. In view of above, I pass following order.

ORDER

(i) The application is allowed.

(ii) The D.V. proceeding PWDVA No. 17 of 2022 pending before the J.M.F.C., Nashik be transferred to Family Court at Nashik.

(iii) Both the parties to appear before the Family Court at Nashik on 29.04.2024.

The Application is disposed of.
