Heard Ms. Pradnya Jadhav, the learned Counsel for Applicant.

The Applicant is chargesheeted in Crime No. 176 of 2017 punishable under Sections 392 read with Section 34 of the Indian Penal Code. After having been arrested on 21st November 2017 almost for last one year the Applicant is behind the bars. There are no criminal antecedents. The recovery of the article which is subject matter of the crime i.e. gold chain was already recovered from other co-accused.

That being so, in my opinion, the case for grant of regular bail is made out. Hence, the following order.
ORDER
(A) The Applicant be released on bail in Crime No. 176 of 2017 for an offence punishable under Sections 392 read with Section 34 of the Indian Penal Code on furnishing PR bond of Rs. 15000/- with two sureties in the like amount.
(B) The Applicant shall attend the Investigating Officer as and when directed.
(C) The Applicant shall not tamper the evidence of prosecution or influence the witnesses.
(D) The Applicant shall keep himself away from the jurisdiction of the police station till filing of chargesheet.
(E) In case if it is noticed that the Applicant is involved in similar type of offence in future, the prosecution will be at liberty to move for cancellation of the bail.
