On 7.6.2016 in Crime No.187 of 2016, it is alleged that pursuant to the offence spelt out under the provisions of Section 392, the applicant claims to have purchased stolen property which was already recovered from him as is reflected in the PCR Extension note July 30, 2016 in Crime No.187 of 2016. The learned counsel for the applicant specifically invites my attention to the Item Nos. 11 and 12 in the said PCR Extention Note.

Perusal of the FIR in Crime No.44 of 2016 depicts that there is already recovery from the applicant and his custodial interrogation as such is not warranted. Hence, in the event of arrest, the applicant shall be released on executing PR Bond in the sum of Rs.50,000/- with one or two sureties in the like amount. He shall attend Shivgan 1/2

13-ABA-1546-2016 the police station as and when called. He shall not tamper with the evidence and/or influence the witnesses. Any further involvement in the similar type of crime will entail the prosecution to move for cancellation of bail.
