DATE : 20 JANUARY 2020 P.C.:- Learned counsel for the Petitioner, after arguing the matter for some time, seeks leave to withdraw the Petition as he states that he will file a review before the Maharashtra Administrative Tribunal. It is his contention that the Tribunal has not considered the interim order passed by this Court which is the basis for recalling the order of promotion, was subsequently vacated. 2.

The Writ petition is, accordingly, disposed of as withdrawn in view of the above.

We make it clear that we have not commented on the merits of this assertion of the Petitioner.

We also note that the order was passed by Tribunal on 18 June 2019 and the Writ petition was filed immediately on 4 August 2019 and if question of delay arises the Tribunal will, no doubt, take this fact into consideration.
