By this Civil Application, the Applicant is seeking condonation of 28 days delay in filing the First Appeal challenging the Judgment and Award dated 07.01.2017 passed by the Motor Accident Claim Tribunal, Mumbai in Application No.2947 of 2010.

Considering the submissions made by learned Counsel for Applicant and averments in the Civil Application, I am satisfied that the Applicant has made out case for allowing this Civil Application. 3.

Hence, following order :

(i) The Civil Application is allowed in terms of prayer Clause (a) which reads thus:

(a) That this Hon'ble Court be pleased to condone the delay of 28 days in filing the present First Appeal. (ii) Civil Application stands disposed of accordingly. [K. K. TATED, J.] 1/1
