Heard the Learned Advocates appearing for the parties. Following order is passed, by consent.

(i) The parties shall proceed with the Motor Accident Claim Petition No.256 of 2005 before the Motor Accident Claim Tribunal at Kalyan. (ii) The Member, Motor Accident Claim Tribunal at Kalyan shall dispose off Motor Accident Claim Petition No.256 of 2005 within a period of 8 weeks from the date of this order. If necessary, he shall proceed with the matter on day-today basis. (iii) Parties and/or their Advocates shall appear before the Member, Motor Accident Claim Tribunal at Kalyan on 11 th August, 2017 at 11.00 a.m. and obtain necessary directions/orders in the matter.

kpd 2 / 2 919-MCA-264-2016.sxw (iv) The Member, Motor Accident Claim Tribunal at Kalyan shall not grant adjournment to either side unless absolutely necessary. (v) The parties too shall not seek any adjournment unless absolutely necessary.

(vi) All contentions of the parties are kept open. 2.

The above Miscellaneous Civil Application No.264 of 2016 is accordingly disposed off.
