The learned counsel appearing for the petitioner tenders on record a compilation of documents which is taken on record and marked `C-1' (collectively) for identification. The first letter is dated 30th June 2018 which is addressed by Captain Manoj P. Nambiar, SO-III (Pers) for Chief Engineer to the Chief Engineer, Pune Zone, Pune. The letter records that the petitioner may be informed to withdraw this petition and submit a fresh application for grant of compassionate appointment as per the revised policy. The second letter dated 2nd July 2018 addressed by Shri Sanjay Ekbote, Dir (legal), for Chief Engineer to the Chief Engineer, Pune Zone, Pune. The letter records that the petitioner may be apprised about the revised Government policy and convince him to withdraw the court case. The third letter dated 10th August 2018
wp1691.doc is by R.R.Meena, IDSE, EE (SG), Garrison Engineer addressed to the petitioner requesting him to withdraw the Court case and submit a fresh application as per the new policy.
In view of these three letters, the learned counsel for the petitioner on instructions of the petitioner who is stated to be present in the Court seeks permission to withdraw this petition with liberty to make a fresh application for grant of compassionate appointment as per the new policy. The learned counsel for the respondents pointed out that in the letter dated 30th June 2018 referred above, in paragraph 3 it is stated that there is no guarantee that the petitioner will get appointment on compassionate ground. Obviously, the petitioner is aware of this fact as the petitioner has himself placed a copy of the said letter on record.
Accordingly, we dispose of this petition as withdrawn with liberty to the petitioner to make a fresh application to the Competent Authority as per the new policy for grant of appointment on compassionate ground. If such application is made, the same shall be disposed of as expeditiously as possible and preferably within a period of three months from the date on which the application is made.
