Heard the learned counsel for the parties.

It appears that the present application was filed in pursuance of the Applicant receiving a notice dated 27.09.2021 from the Sub-Divisional Police Office, Alibaug in connection with a complaint lodged by Sunil Sampatrao Chauhan. However, it is not pointed out at this stage by the Investigating Officer, who is present before the Court that a formal FIR is registered. It is submitted that the Investigating Officer shall issue 72 hours notice to the Applicant in the event, the Investigating Officer Sneha Chavan page 1 of 2

17 ABA 2540-21.doc intends to arrest and obtain the custody of the Applicant. Statement so made is accepted.

The Criminal Application is disposed of in view of the said statement, with liberty to the Applicant to renew the request for anticipatory bail, in the event of receipt of such notice from the Investigating Officer.
