The petition is fled by the petitioner/husband raising an objection to an order passed by the Family Court, Pune on 07/09/2021, on an application moved by the wife for recording the transcript of Audio and Video CDs through the Court Commissioner.

The said application was made in the background of an averment that the said Audio and Video CDs contain the conversation as well as chatting in between the parties and it is necessary to be brought on record.

Considering that the petition has been fled by the wife, seeking a declaration of nullity, which is subsequently sought to be converted into the petition for marriage, I do not see any illegality or perversity in the said order, since an Advocate is appointed as Court Commissioner and has been directed to record the conversation in the Audio and Video CDs in writing. The report was directed to be submitted before the next date of hearing and the petitioner was also directed to bear the expenses of Court Commissioner for recording the transcription contained in the Audio and Video CDs. Finding no legal perversity, upholding the impugned order, the present writ petition stands dismissed. ( SMT. BHARATI DANGRE, J.) M.M.Salgaonkar
