The learned Counsel for the petitioner submits that the grievance is made to the Education Offcer with regard to the transfer of the petitioner and further that he does not want to claim a promotional post.

As far as transfer is concerned, the power would vest with the Chief Executive Offcer of Zilha Parishad. The petitioner may make a representation to respondent No.2 in that regard. In case such a representation is made by the petitioner to the Chief Executive Offcer, Zilla Parishad, Pune Region, then the Chief Executive Offcer, Zilla Parishad, Pune Region shall decide the same on its own merit in accordance with law preferably within four months from the date the representation is made and the present order is communicated to him.
