IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 9745 OF 2019 Satish Bapu Khilare ...

Petitioner V/s.

Priti Satish Khillare ...

Respondent ----- Mr.Abhishek Patil for Petitioner.

CORAM : A.S. GADKARI, J.

DATE : 25th November 2019.

P.C. :

1] By the present Petition under Article 227 of the Constitution of India, the petitioner-husband has impugned Order dated 20th June 2019 passed below Exhibit-122 in P.A. No.500 of 2014, thereby directing the petitioner to produce on record certain documents, i.e. Salary Slips for the month of April 2019 and May 2019, Income-Tax Returns of Last Assessment Year, Credit-Card Statement of past Three Months and his Bank Statements of past six months, for considering the application for interim maintenance of his daughter. 2] Perusal of record would indicate that, the Order passed by the Trial Court is just, right and judicious Order. It clearly appears that, the present Petition is filed only to procrastinate P.A. No.500 of 2014 filed by the 1/2

osk 16-wp-9745-2019.odt respondent-wife and none else. The pleadings advanced across the bar are dehors of any merits in challenge to the impugned Order. 3] As noted earlier, by the impugned Order, the Trial Court has only directed the petitioner to produce certain documents for adjudication of the claim of his own daughter. The contention that, the respondent is not producing certain documents as per the Orders passed by the Trial Court cannot be considered in this Petition, as it has no bearing in deciding the present Petition. 4] Petition is dehors of merits and is accordingly dismissed in limine.
