Heard the learned counsel for the parties.

Both the Civil Application are for fixing early date of hearing of First Appeal No.492 of 2005 and 493 of 2005 on the ground that applicant is Senior Citizen and for other consequential reliefs.

The learned counsel for the applicant at the time of argument made a statement that applicant is not pressing for any other consequential relief except for early hearing.

Considering the submissions made by the Mohite 1/2

26 caf1090-14withcaf384-14.doc learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing partly the present Civil Applications. Hence, following order:

a) Hearing of First Appeal No.492 of 2005 and 293 of 2005 is expedited.

b) Office is directed to place both the First Appeals on board for final hearing in the weekly board in the list of Senior Citizens as per its turn. c) Liberty granted to the parties to file additional compilation and paper book in the Registry and serve copy on the other side.

d) Civil applications stands disposed off accordingly.
