DATED : 7th SEPTEMBER 2022 P.C:- The learned Special Public Prosecutor inform that at present, six witnesses are examined and seventh witness is in the box and the prosecution intend to examine approximately 35 witnesses in total.

The learned counsel Mr.Saraogi is perfectly justified in submitting that he has been arrested on 4/5/2018 and since then, he is incarcerated. The long incarceration by itself has been pressed into service as the ground for the applicant being released on bail.

2/2 50 BA 3718-21.doc The learned Special Public Prosecutor state that every attempt shall be made to conclude the trial within a period of six months from today, subject to the co-operation being rendered by the counsel for the accused.

In the wake of the aforesaid statement, Mr.Saraogi seek permission to withdraw the application. He, however, seek liberty to approach this Court in case the trial is not concluded within six months from today.

Reserving the liberty as prayed for, application is disposed off.
