1) This is an application through jail. Heard the learned Counsel appointed for the applicant and the learned APP for the State.
2) The learned Counsel appointed for the applicant submitted that the applicant is an accused in a crime originally registered with Kurar Police Station, Mumbai and subsequently transferred to DCB, CID Unit No.12, Mumbai. She submitted that the applicant is arrested on 24.12.2014 on suspicion and during his search one live cartridge was found on his person. As the applicant could not produce any document about the possession of said live cartridge, the police have arrested him
2 /3 21-BA-1744-2015.doc and since then the applicant is behind the bars. The learned APP submitted that the applicant was earlier convicted for a similar type of offence and was sentenced to undergo two months and 15 days of imprisonment and, therefore, he cannot be released on bail.
3) It is fact on record that the applicant was apprehended on suspicion and was found in possession with one illegal live cartridge. The maximum punishment in the said crime is about seven years. In view of the above, I am inclined to release the applicant on bail.
4) Hence, the following order :
ORDER:- (a) The applicant shall be released on bail in Special LAC No.227/2014 of registered with Kurar Police Station, Mumbai and subsequently transferred to DCB CID Unit No.12, Mumbai on his furnishing P.R. bond of Rs.25,000/- with one or two solvent local sureties in the like amount; (b) The trial Court is hereby directed to verify the genuineness of documents of the surety submitted by the applicant through the concerned Police before releasing the applicant on bail; (b) After release from jail, the applicant shall attend the office of DCB, CID Unit No.12, Mumbai on every first and third Monday of the month
3 /3 21-BA-1744-2015.doc between 11:00 a.m. to 1:00 p.m. Any single default at the instance of the applicant will attract his cancellation of bail on an application filed by the Investigating Agency;
(c) Before parting with the order, this Court places on record the appreciation about the efforts put in by the learned appointed Counsel Ms Rohini Dandekar to represent the applicant.
