1] The learned APP fairely states that the subject CR in which the applicant is apprehending his arrest came to be registered in the year 2016 and on completion of investigation charge-sheet has been filed against the co-accused.

2] It is stated that the Applicant was however not traced and therefore no charge sheet is filed against him. She states that custodial interrogation of the applicant is not warranted, but he must render his co-operation to the Investigating Officer in order to ascertain his exact role.

3] In the wake of above, the Applicant needs to be protected. 1/2

O R D E R

(a) Application is allowed.

(b) In the event of arrest in connection with C.R.No.710/2016 registered with Kashimira Police Station, the applicant Dinesh Subbaya Amin shall be released on bail on furnishing P.R. bond to the extent of Rs.25,000/- with one or two sureties of the like amount. (c) The applicant shall report to the concerned police station on 28.09.2022 to 30.09.2022 between 3.00 p.m. to 6.00 p.m. and thereafter as and when called for. (d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence.
