After arguing for some time, since the recording of evidence in the trial, of which transfer is sought, has commenced, learned counsel for the applicant does not press this application and seeks leave to withdraw the application. She, however, requests that the trial of Criminal Misc. Application No. 89/2016 pending before the Juridical Magistrate First Class, Baramati, be expedited. Accordingly, the application is disposed of as withdrawn. SQ Pathan 1/2

appln.440.18.905.doc Considering the fact that the recording of evidence has commenced, learned trial Judge to dispose of the case as expeditiously as possible and in any event, within 6 months from the date of receipt of this order.

The trial Court to communicate the aforesaid order to the respondent No. 2, as the respondent No. 2 has failed to appear in the aforesaid proceedings, despite notice being issued and if she is represented by advocate, to the advocate concerned. All concerned to act on the authenticated copy of this order.
