Learned Counsel for the applicant seeks leave to withdraw this application with liberty to file an appropriate application before the learned Additional Chief Metropolitan Magistrate, for seeking modification of the order dated 16th August, 2017, in particular, para 6 clause (1), which directs the release of the applicant on depositing an amount of Rs. 32.35 crores. 2.

Accordingly, the application is disposed of as withdrawn, with liberty as prayed.

It is made clear, that if such an application seeking modification of the order dated 16th August, 2017 is filed by the applicant, the same shall be decided within three days of the filing of such application.
