This is the second Bail Application is moved by the applicant/accused. He is prosecuted for the offences punishable under sections 302, 201 r/w. 34 of the Indian Penal Code and under sections 3(1), 3(2) and 3(4) of MCOC Act in C.R. No. 65 of 2012 registered with Bazar Peth Police Station, Kalyan. The First Bail Application of the applicant/accused was rejected by this Court on 10th April, 2014. 2.
The learned counsel for the applicant/accused has submitted that at the time of dismissal of the First Bail Application, 28 cases were pending against the applicant/accused, however, as on date, either the applicant is discharged or acquitted from these cases, except three cases and that is a change of circumstance.

I have perused the order. My predecessor has considered the evidence in the present offence and has dismissed the Application not only on the basis of previous record. There is no change of circumstances. I am informed by the learned APP that charge is framed in this matter, as it was registered in the year 2012 and witness summons are issued. Now the case is scheduled for recording of evidence from 5th May, 2016 onwards. 4.
Bail Application is rejected.
