The learned Counsel for the applicant submits that the applicant is in custody since February 2007. He further submits that if the appeal is expedited and fixed date of hearing is given, he will not press the application for bail.

Looking to the fact that the applicant is in the custody since February 2007 and the appeal is of the year 2009 and at present the appeals for the year 2009 are on board for hearing, the hearing of present appeal is expedited.
